Maryland’s Attorney General’s Office files Three False Reports against a Physician

Three false documents have been filed against Mark Davis MD in recent years by the Maryland Attorney General’s Office. These documents were filed for proceedings before the Maryland Board of Physicians and were written by Robert Gilbert Esquire, a subordinate of the Attorney General and a holdover from other Administrations. This toxic human being has focused his hate and inability to tell the truth, in his capacity as an attorney employed by Maryland, against this physician. The substance of his actions was most recently heard during a hearing on December 21, 2016 before the Maryland Board of Physicians. Gullible Board members nevertheless gave this despicable human being’s statements credibility while ignoring documented facts presented to this Administrative authority by Mark Davis MD. The Executive Director of the Board, Christine Farrelly, bought into to every statement and written word he annunciated and or created. Since it is the job of the accused to display his innocence and to display the guilt of others Dr. Davis gave the Board a packet which contained page after page of well documented facts that countered every aspect of Mr. Gilbert’s incredible misrepresentation of Dr. Davis’ background

and recent history. Mr. Gilbert’s polished legal tones and repetitive lies carried him over the finish line and Dr. Davis was refused his well- deserved medical license. Further he was told by Ms. Farrelly, in a letter, that the Board will not entertain another request for licensure. How did an attorney become the Executive Director of a Medical Board is beyond my comprehension, yet it is so in Maryland.

The Board’s Executive Director Christine Farrelly is playing God with physician’s careers. She has overstepped her authority on many levels and has failed to investigate the true facts involving  Dr. Davis’ background and history. Under her tutelage physicians can lose their licenses when only one doctor makes a complaint against another. Yes, Soviet Russia has come to America. Ms. Farrelly should be removed from her post and stripped of her immunity for failing to guard the rights of physicians. After a contrite Dr. Mark Davis appeared before Maryland Board of Physicians on December 21st 2016, completely out of character for him, Farelly and Gilbert pissed on him. To display how dirty and illicit this Board has become Dr. Davis made a Public Information Request for information related to the hearing on December 21st 2016. The request for information and the Board’s answer is below. Ms. Farrelly and her minions her hiding behind archaic rules using legal chicanery to block release of the requested materials. The Board even went so far stating Dr. Davis can seek judicial relief in a Maryland Court. In a judicial system that kisses the behinds of their Administrative authorities the Board is aware there is no chance for judicial relief. With immunity to all players and a thousand legal roadblocks at their disposal Ms. Farrelly and mob do not want the truth to come out, only her version should be heard. To me it sounds like we are back forty years ago when Nixon stated he was not a crook, as he leaned on a dozen Bibles.

     On December 21st 2016 Mark Davis, MD was invited to appear before a committee of the Maryland Board of Physicians. He was specifically present to request reinstatement of his medical license. There were numerous participants in attendance for this hearing. Mark Davis, MD respectfully requests the following information be sent to him as allowed under the Maryland Public Information Act.

The enumeration is below.



1) Any and all transcripts, tapes, stenographic records, notes or other means in which data was stored, collected and or recorded for this hearing.



2) The names of all people in attendance at the time of this hearing.



3) Any and all notes, records, recordings or other means by which legal counsel to the Board generated and or collected information from this hearing.



4) Any and all records, whether written or electronic, generated by the Executive Director of the Board, physician members of the Board, administrative staff to the Board, non-physician members of the Board  and or anyone else in attendance which the Public Information officer has access to their records.

Brian Frosh: Maryland’s next Attorney General

 

Maryland’s Attorney General Office is in dire need of an overhaul. Most recently this Office has been managed to enhance the career of its current occupant with less emphasis on those who matter most, the State’s six million residents. Political agendas not sound judgment has been on display over the last 8 years. Maryland is ready for a change. Brian Frosh, a consummate Maryland politician and lawyer, will bring a fresh perspective to an Office that has seen better days. Frosh has a stellar record of accomplishments as a current member of the Maryland Senate and previously in the House of Delegates. In his 5th term in the State Senate Brian Frosh is highly regarded for his commitment to an array of causes which enhance the lives of those he serves. On important environmental issues, such protecting the Chesapeake Bay and its tributaries, he has been an outspoken critic of anyone or group who would endanger these areas. For his efforts on the environment Frosh has received numerous awards including “Conservationist of the Year” from the Sierra Club and “Public Official of the Year” by the Audubon Society.

 

Senator Frosh has taken a lead role to create legislation that protects children and victims of domestic violence. He has been behind legislation to revise child support laws which were sadly lagging behind the times. On education his efforts helped to make tuition in colleges more affordable with an accentuation on increased quality. As chairman of the Judicial Proceedings Committee he steered bills through a political maze to protect personal data held by the Motor Vehicles Administration. Frosh was instrumental in enhancing identity theft laws and creating new mechanisms to track those who defraud Maryland health systems.  His years in the House of Delegates and the Maryland Senate display a record of exemplary service to the state. Support for his candidacy is strong within this State and outside its borders. Former New York City Mayor Michael Bloomberg supports Frosh for taking a major role in helping enact into law the Firearm Safety Act. Many other Maryland luminaries have given a thumb’s up to Frosh’s candidacy.

 

Maryland’s Attorney General Office provides legal counsel to a variety of administrative entities throughout the state. Legal opinions crucial to this State’s functions also emanate from this office. Politicized by the current occupant the Attorney General should always present a balanced approach to whatever task is before his office. Having been touched by the civil sting of this office whose methodology was nothing less than confrontational, contentious and misdirected a fresh face is needed to rekindle trust this office once held. Brian Frosh is that person. He is able to maneuver through the embattled political terrain in Maryland with the knowledge to apply the laws equitably without destroying the faith in the people he serves. Strong consideration should be given to this candidate for Attorney General. As an independent I see Brian Frosh’s resume as many steps above the recent holders of this office.  Maryland needs change and it is coming to the Attorney General’s Office in the embodiment of Brian Frosh.

Four thousand reasons not to vote for Douglas Gansler

 

Do you really know who Douglas Gansler is? His manufactured bios and selectively placed internet references do not provide a full picture of the man who wants to be Maryland’s next governor. Gansler’s moves are managed to enhance his own career at the expense of any person or persons who get in his way. His Civil Rights record is a series of vacuous statements which helped few while harming many. Without the ability to notify his patients Dr. Mark Davis was forced to abandon over 4,000 of them in the space of one day. Two of these patients subsequently died shortly afterwards.  Gansler’s Office concocted a series of specious civil charges against Dr. Davis that were so profoundly erroneous one would think its author was writing a piece of fiction or a psychopath. To fully understand the breadth and depth of his Office’s prosecutorial misconduct a brief summary of this egregious case will flesh out how his Office intimidates physicians with bogus legal maneuvers.

 

The tentacles of the Attorney General’s office are intertwined throughout every Maryland government entity that carries out State laws and regulations. Maryland’s Board of Physician’s has attorneys from Gansler’s office that advise the Board and others who bring prosecutions against physicians. This Board consists of 21 members 8 of which are usually non-physicians. The Maryland Board of Physicians is dependent on “lawyers” to explain so-called standards of care to those members of this entity who are uninitiated in medical practice. Sadly this Board was seriously misguided by Gansler’s office. Civil charges against Dr. Mark Davis concerned the class four diet drug Phentermine. These civil charges included but were not limited to: 1) Not obtaining written informed consent from patients (no such rule for the use of Phentermine exists in Maryland or the USA), 2) failing to keep adequate medical records (all forms in Dr. Davis office were preprinted and had prior approval from the Maryland Board), 3) continuing patients on Phentermine too long (patients were on low maintenance doses which is the standard in weight loss clinics in Maryland, 4) not using the measurement called body mass index ( a 150 year old measure which has come into dispute for its accuracy), 5) not doing physical exams ( every chart in question had both a physical and history form attached. To defend these charges two physicians were appointed by the Board in conjunction with Gansler’s office.

 

During a hearing before an administrative judge one of the state’s physician witnesses was completely discredited and his testimony thrown out. The second witness was not sworn in by the judge and was free to commit perjury at his leisure. This physician admitted during cross examination he had minimal to no experience with the drug Phentermine, yet he was appointed as an expert witness. One must read the testimony of this “paid”hired gun to understand the depth of his lies. Gansler’s appointed assistant blocked Dr. Davis from presenting physician witnesses (one of whom is a nationally known expert on diet medications), inhibited patient testimony, inhibited Maryland Pharmacy Board testimony, blocked introduction of numerous exculpatory documents and used other legal chicanery to win at all costs. Even though Dr. Davis was inhibited from putting on a defense, the judge found mostly for him. Gansler’s Office would not be defeated and went before the Board of Physicians with more lies and deceit to knock out the judge’s recommendations which were very positive to Dr. Davis. The Medical Board, who never heard the entire case, circumvented their own regulations which required a minimum of two physicians to be in absolute agreement before action can be taken on a physician’s license. Dr. Davis’ medical license was revoked for three years based on one physician’s specious testimony and a judicial forum which was nothing less than a circus. The question is still remains: How much money did Gansler waste in this false civil prosection?

 

In Douglas Gansler’s world it appears that Civil and Judicial rights are for some not others. There was never a patient or physician complaint against Dr. Davis to initiate this process. In the aftermath there were no malpractices suits instituted against Dr. Davis. Much more could be written on the legal aspects of this case. Needless to state the left wing appellate judges basically sided with any nonsense Gansler’s lawyers presented to them. There are over four thousand people who will not vote for Douglas Gansler and I am one of them for the aforementioned reasons stated here and much more. I urge people to look more closely at Gansler’s record, you may not like what you see.

Douglas Gansler, Maryland’s Attorney General and gubernatorial hopeful initiated his campaign for higher office by introducing racism into the mix. Anthony Brown, the present lieutenant governor, was slighted by Gansler who was noted as saying Brown has few accomplishments and is relying on his race to win the 2014 primary. Gansler, who purportedly was a defender of Civil Rights during his tenure in office, appears to be opposed to them when a politician running against him is of another race. To make matters worse Gansler’s running mate Jolene Ivey staked out a claim of her own in this racism dialogue. The first few words from her when chosen to run for lieutenant governor were: she is a Trayvon Martin mom. Race appears to be on the minds of both of these candidates for higher office. Gansler was the first Maryland Attorney General to establish a Director of Civil Rights position within his department. The question is whose Civil Rights were being monitored. His Voting Irregularities Task Force was setup to ferret out voter suppression throughout Maryland. One must suspend disbelief to believe any Maryland voters were stopped from casting their ballots. Obviously the present Attorney General was pandering to 30% of the state who are of the black culture. If there is any suppression of voters’ rights in Maryland Afro-Americans are the least affected. Gansler’s attempt to bring attention to himself can be observed in the many high profile legal cases he brings to the forefront. His stance on issues has the stench of far left politics. As a physician who has been through the milieu of professional and political assassination by Gansler and his minions, he appears not to care if a legal case has credence only that it is media worthy. Recently the Maryland State Education Association overwhelmingly supported Brown in his efforts to become Governor. Too many contradictions follow Douglas Gansler in his crusade to move up the food chain. Needless to state, his present temperament on race contradicts his prior profile and its scent has been picked up by many who are looking away from him and towards Anthony Brown. Gansler has stung many to justify his political position, now his own words are biting him back. Perhaps Douglas Gansler should reconsider his run for governor, it appears others have. Maryland needs leaders not followers

 

Maryland’s Governor and Attorney General (AG) are running away from their respective offices to move higher on the food chain. Governor Martin O’Malley has his eyes on the White House as Attorney General Douglas Gansler looks towards the State House. Governor O’Malley’s few accomplishments are drowned out by the enormous number of unsolved problems he will leaves in his wake. Violence throughout the state of Maryland, especially in Baltimore City and Prince George’s County, has only received lip service from someone who incessantly brags of his nonexistent achievements. Taking his lead from President Obama, Governor O’Malley will waste several billion dollars or more on green projects to nowhere. Under his mindless tutelage a rain tax now falls across Maryland, the only state in the union to institute such idiocy. Taxes, tolls, assessments and other financial extortions from the state have moved up exponentially to fund O’Malley’s massive entitlement structure. Efficiency is not in the Governor’s vocabulary. His inability to understand business dynamics caused Maryland to be named a business unfriendly state by those in the know. In the event this is the record O’Malley will run on, conservatives will have no fear of him succeeding.

 

Attorney General’s office sits in prime real estate in the midst of Baltimore City, not in the less expensive state towers on Preston Street. From this perch a panoramic view of Baltimore’s nightly blood bath is evident. Since his installation as Attorney General, Gansler has made no effort to stem the flow of violence surrounding his office or elsewhere in the state. The daily body count attests to the fact that his very liberal agenda, to retain office, excludes the possibility of taking on the true challenges necessary to reduce the death toll. Gansler’s well concocted bio displays his strong push for; nontraditional marriages, health care solutions through the abomination called Obamacare, gun control for victims not victimizers, diversity in state appointments without consideration for merit, baseless green energy projects and numerous other left-wing assaults driving businesses to more friendly environs. Baseless lawsuits against physicians are one of his office’s specialties. Douglas Gansler has intimidated a sufficient number of people to keep his name afloat in the media, not to dissimilar from another cohort Eliot Spitzer, who followed the same path from AG to the Governor’s office in New York. Power hungry people will go to many lengths to stay in positions that give them control over others, Gansler is no different. Recently, Gansler made several gaffes when he insisted his opponent Lieutenant Governor Anthony Brown, an Afro-American, has only his race to offer as a justification for seeking the governorship.  This denigrating statement may move many out of his camp for obvious reasons. According to Gansler’s bio Civil Rights are a high priority for him, yet his speeches appear to reflect otherwise.  Both Martin O’Malley and Douglas Gansler have their priorities misplaced. Their motivations for seeking office have less to do with improving living conditions in Maryland than staying in positions of power at all costs. With these two men in charge Maryland has become more blue pushing state coffers into the red. Neither one should be honored with higher office, yet knowing Marylanders they like the status quo.
